Notification Regarding the Issue of Casual Leave by the School Education Department Punjab

School Education Department Punjab has issued a Notification No. SO (SE-III) 7-281/2012 dated 29th March 2013 regarding the issue of Casual Leave. The story of this order is as under:

The Writ Petition No. 28761/2012 filed by Mr. Shakeel Ahmad, EST (DM), Govt Technical Model High School, Jauhrabad district Khushab was disposed off with the direction to Secretary Education School to look into the grievance of the petitioner and decide the matter expeditiously in accordance with law/rules after affording an opportunity of hearing to all stakeholders.

The grievances of the petitioner is that the instructions given by the EDO (Edu) Khushab to the DEOs and Dy. DEOs in the meeting held on 28-02-2012 regarding sanction of casual leaves and same were circulated 03-11-2012 be set aside.

In compliance to the orders of the court following steps were taken:

a-                          The petitioner was afforded personal hearing in the presence of Mr. Muhammad  Hussain Assistant Director Litigation o/o EDO (Edu) Khushab and heard at length and

b-                          The report sought from EDO (Edu) Khushab and available record was perused and following facts are observed:

(i)                  To achieve 100% attendance of students, 100% retention of students, academic results and more than 90% teacher’s attendance etc, the EDO (Edu) Khushab gave following instructions to the DEOs and Dy. DEOs in the meeting dated 28-02-2012 regarding casual leave that was circulated on 03-11-2012:

More than 1 casual leave should be allowed in special cases otherwise only one casual leave in a month is admissible. Medical leave will be given to teachers on the production of Medical Certificate duly countersigned by the Medical Superintendent and not more than 5% teachers be out of school.

(ii)                The attendance of teachers and child friendly atmosphere is necessary to achieve the target of free and compulsory education upto the age of 16 years under Article 25 (A) of the Constitution of Islamic Republic of Pakistan.

(iii)              The petitioner failed to present his application regarding sanction of casual leave which was rejected by the Sanctioning Authority and

(iv)               The petitioner also failed to produce the registration certificate of so called Primary Elementary Teachers Association and legal notification regarding his appointment as Central And Provincial Chairman Election Board , Primary Elementary Teachers Association.

The petitioner is not aggrieved person. The teachers are entitled casual leave in special circumstances under revised leave rules 1981 and can proceed on leave with prior sanction of leave by the sanctioning authority. In view of the above, I Muhammad Aslam Kamboh, Seretary School Education, hereby reject the representation of the petitioner, Mr. Shakeel Ahmed EST (DM) being devoid of merit and against the rules/policies.
