Notification of Protection of Pay of Contract Employees on Regularization/Appointment on Regular Basis

Govt of Pakistan Finance Division Regulation Wing, Islamabad has issued Notification No. F.No. 79/)R-I/2012 dated 31st May 2013 in connection with the protection of pay of the contract employees on regulation or appointment on regular basis. The proposals for protection of pay last drawn by the contact employees on their regularization/appointment on regular basis are received in the Finance Division and considered/decided on case to case basis. The existing rules/orders on the subject don’t provide for protection of pay of contract employees on their regularization. The courts have held from to time that the pay of contract employees on their regularization appointment on regularization basis should be protected.

The matter has been examined in the light of court’s judgments and it has been decided to issue general policy guidelines in this regard. Pay of a non-Gazetted Contract Employee on his regularization/appointment on regular basis will be protected subject to the following conditions:

  • That the contract appointment has been made on standard terms and conditions circulated by Establishment Division as amended time to time.
  • That the contract employee has applied through proper channel and has been properly relieved by the appointing authority. This condition shall not apply in case of regularization on the same post.
  • That regularization/appointment has been made with the approval of the competent authority.
  • That there is no break/interruption between contract service and regular service.
  • That the service rendered on contract basis shall not qualify for pension/gratuity purpose.
  • That in case of regular appointment in lower grade pay shall not be protected.

Ministries/Divisions/Departments are authorized to protect/fix pay in term of above guidelines. Only those cases may be referred to Finance Division where some clarification or advice of Finance Division is required.

  1. Madam i saeed bhutto. Iam working in npiw project since 2005 on contract basis. Now we all employs regularised on dated 22 july 2016. Madam sindh govt given no seniority and no any any pay protection. How we will get thesebenifits?

  2. Dear madam i saeed bhutto and working in sindh government as a sub eng bps 11. Madam i appointed in in npiw project since 2005. Now sindh government regularized all npiw staff. I have notification copy so if madam u needed then i will send u. My basis two question one is how we will get seniority? And pay protection

    I want to ask that is there any notification regarding Pay Protection of Gazetted contract employees appointed in autonomous bodies.

    1. Dear Abdullah, i have asked same question from one of official at MoF. he told that a proposal regarding Pay Protection of Gazetted contract employees is under consideration and hoped to be finalized soon. for further detail u can ask latest from MoF no.

  5. Dear Sister I am working under punjab govt. in Judicial department. Is this notification only for federal govt. not for provincial govt. please clarify. firstly i was work on contract basis in district govt. in BS 12 and now i was appointed in BS 14 in judicial department. i applied through proper channel and relieved. please guide me in this matter.

          1. if a person is working in BS-15 on contract basis and through proper channel applies in another department for a post of BS-11 and ultimately selected in the applied department which is regular in nature. His parent department re-leaves him to join the department…… Please let me know whether he is entitled for pay protection under the light of this notification.

  7. AOA Sister main 2002 main Education dep main ESE appoint huwa tha 2009 main BPS 9 main regular kar dea gea lekan pay bhe BPS 9 Main 3820 kar de gae. Aur baqi ko Personal Allowance bna dea gea.Ab agar pay protection Punjab walay karte hain to jo azafa 2010 main 50%huwa ya bad main wo hamein milay ga ya nahe.Agar milta hay to please bta dain hamari pay andazan kitni ho jaäy ge

    Dear Sister,
    i am working in B.I.S.E, Bahawalpur as Junior Clerk. I was appointed as Junior Clerk on Contract basis in 2006. Later on Govt. of the Punjab has regularized all the contract employees since 14.10.2009 but my basic pay start with initial stage of pay with all old increments since 2006 goes to special pay allowance.
    1. So this notification can help me and how ?
    2. Are we wait the notification of govt. of the punjab ?

    is that means that those employees who were regularized via continuation of contract post ,will not enjoy pay protection;like nurses who were appointed in BPS 16 on contract in 2002 and regularized through one time relaxation,in 2010 will not enjoy pay protection

  10. dear sister. Main 2008 main as junior clerk appoint hoa tha contract py. Jabky hamen 2009 main permanent kr dia gya. lakin jab pay fix ki gai to 2009 wali increment kat li gai or hmari pay main ak increment kam ho gai. Kia ye notification hmari help kry ga? Or agr han to kia hmen recovry di jay ge. Plz guide

  11. Salam… Mere Bhai 1993 se contract pe as a Medical officer kaam ker rahay thay than woh 2012 mein regular huay jab unki age 51 hogai thee aur woh 10 saal apni service na hone ki waja se pension nahi lesakengey kia yeh notification se unko koi faida hoga??? unki service count hogi??

      1. doctor sahib should go to the courts for regularisation of service from the date of initial appointment as contract i-e since 1993 . only then can get pension benifets;

  13. Dear sister, mein bps 3 ka regular employee hon in sindh govt with 7 years service. Hamesha through proper apply kya magar kam nhi hota tha. Ab primary school teacher BS-9 k lye Direct apply kya to to final list me jin ko order mily gy, me nam aya hy. Advertise me clear lijha hua hy k through proper apply karen. Ab agar na bataya to service zaya ho jai gi. Btany pr dar hy k kahen gay k jab advertise mein likha b hua tha to ap ny direct apply q kya. Koi problem na ho jai. Abhi education dept. Sindh ny documents bheje hoy hain verification k lye. Verification clear hoty he offer order mil jai ga. Plz help me kya karo.
