A bill regarding Punishment Dishonestly Issuing Cheque Which is Dishonoured on Presentation has been passed and this Act may be called the “Criminal Laws (Amendment) Act 2018.Some points of the same are as under:
489 F. Dishonestly issuing a cheque: – Who ever dishonestly issues a cheque towards payment of a loan of fulfillment of an obligation and which is dishonoured on presentation shall be punishable: –
[a] if the amount mentioned in the cheque is less than million Rupees, with imprisonment of either description for a term which may extend to three years or with fine which shall not be less than double of the amount mentioned in the cheque or with both; or
[b] if the amount mention in the cheque is one million Rupees or more but less than five million Rupees, with imprisonment of either description for a term which may extended to five years or with fine which shall not be less than double of the amount mentioned in the cheque or with both; or
[c] if the amount mentioned in the cheque is five million Rupees, or more but less than the million Rupees, with imprisonment of either description for a term which may extend to seven years mentioned in the cheque or with both; or
[d] if the amount mentioned in the cheque is ten million Rupees or more, with imprisonment of either description for a term which may extend to ten years or with fine which shall not be less than double of the amount mentioned in the cheque or with both.
