Ban on Transfer / Posting A Notification by ECP

The Election Commission of Pakistan issued a Notification on 14-09-2022 in connection with Ban on transfer / posting A Notification by ECP. The details are as under:

Ban on Transfer / Posting due to By-Election

 

The Election Commission Of Pakistan issues a notification about the banned posting/transfer.  It is declared in light of the election act, of 2017.  The Transfer or posting is not allowed for a specific period as a by-election schedule has been issued.

Further details of the matter are as follows:

 

Notification regarding ban on transfer or posting:

 

   The Election Commission of Pakistan has released a notification to notify all concerned authorities and officials. ECP issued the notification on 14th September 2022. ECP directed the different authorities and government functionaries regarding the Election Act of 2017.

  The Election Commission of Pakistan says that no government authority has permission to make any transfer or posting.

 

Ban on Announcement of any development scheme:

 The Election Commission of Pakistan (ECP) also notifies that no government functionary or elected representative(s) can announce any development scheme for constituents. Also, Local government functionary or elected representative(s) is forbidden to announce such schemes.

Election Act 2017

 

As followed by sub-section 4 of Section 5 & section 181, Election act 2017, any government authority is forbidden to make transfers/postings.

Period of Ban:

 

    The period of ban on posting/transfer in districts where bye-elections are scheduled, starts from the day, as bye-elections are scheduled and during the whole process of bye-elections the ban continues.

According to ECP the schedule of bye-elections they have issued on 28th July 2022 and 5th August 2022 and respectively till the publication of the name of the returned candidate.

 

Duration of the process of Bye-elections:

 

  According to ECP, The bye-elections are scheduled on 28th July 2022 & 5th August 2022. These elections are under process till 16th October 2022.

The copies of the notification dated 14th September 2012 the office has sent to different authorities and concerned officers. The concerned office has published the same in the Gazette of Pakistan.
