Government of the Punjab, Finance Department issued a clarification Notification on 16-11-2022 in connection with Upgradation of Computer Personnel (TSPU). The details are as under:

Will the Section Officer (ADMN-III), Government of the Punjab Agriculture Department. Kindly refer to his letter No. SO(A-III)2-1/2008-I-63230 dated 03-11-2022 on the subject noted above?
The case has been examined. Finance Division observes that due to an amendment in Service Rules on 29-06-2010, the incumbents of the post of Computer Operator ceased to be entitled to promotion against the post of Computer Programmer. Moreover, they did not avail of any benefit of promotion on the basis of the previous service rules 2003. Wherein promotion was available for them against the post of Computer Programmer. Hence they are entitled to Time Scale Personal Upgradation (TSPU) as Senior Computer Operators (BPS-16). Programmer (BPS-17) on completion of 8 & 16 years regular service respectively in terms of Finance Department’s Notification No. FD.PC.40-43/2017 (E) dated 14-12-2018 read with clarification No. FD.PC.40-43/2017 dated 24-07-2019.

Cont..Shahzada Nadeem is one of the petitioners in WP No.5407/2020 disposed of vide Order dated 21-09.2021with direction to worthy Finance Secretary to decide the representation of the petitioners. A personal hearing was held on 26.10.2021. Speaking order has been issued on 09.10.2021; wherein, the incumbent of the post of Computer Operator (BS-14) including the above applicant, keeping in view the prescribed qualification, have declared to be entitled to up-gradation / re-designation as a Computer Operator (BS-15) entitled to Time Scale Personal Up-Gradation (TSPU) with effect from the date of completion of 8 years regular service in light of para-1(v) of Notification No.FD.PC.40-43/2017(E), dated 14.12.2018.Court Decision I am further directed to state that the applicant is claiming TSPU as Senior Computer Operator (BS-16) w.e.f. 28.02.2017 (date of completion of 8 years regular service as Computer Operator BS-14) as his date of appointment is 28.02.2009; whereas, the above policy is effective from 14.12.2018. Hence, he would be entitled to TSPU as Senior Computer Operator (BS-16) w.e.f. 14.12.2018 (date of introduction of policy) instead of 28.09.2017 (date of completion of 8 years regular service as Computer Operator BS-14).
ہم فدویان 1995 کو بطور اکاونٹس کلرک سکیل نمبر۔08 تعینات ہوئے۔ اس وقت ہم 28 سال سروس کرچکے ہیں۔ہماری سالہ 28 سروس میں اج تک ہمیں نہ تو دیگر کلریکل پوسٹوں کی طرح سلیکشن گریڈ ملا ہے، نہ ہی پرموشن ملی ہے اور نہ ہی اپگریڈشن سے ہمیں استفادہ کیا گیا ہے۔اپنے حقوق کی خاطر اپنے ڈیپارٹمینٹ ٹیوٹا لاہور/ فنانس ڈیپارٹمینٹ پی سی سول سیکرٹریٹ لاہور کئی مرتبہ کی گزارشات کیں لیکن ارباب اختیار نے ہماری نہ سنی تو دلبرداشتہ ہوکر ہم نے2010 میں لاہور ہائی کورٹ ملتان بینچ میں کیس دائر کردیا کہ فنانس کے نوٹیفکیشن ،2009 کے مطابق ہماری پوسٹ کو بھی سکیل نمبر۔08 سے سکیل نمبر۔11میں اپگریڈ کیا جائے۔ جسکا فیصلہ 2019 میں جاکر ہوا جس میں جناب جیسٹس لاہور ہائی کورٹ ملتان بینچ نے فنانس ڈیپارٹمینٹ پی سی سول سیکرٹریٹ لاہورکو لکھا کہ ان پوسٹوں پر نظرثانی فرمائی جائے ۔ کورٹ کے کے فیصلے سے قبل2018/12/14 کو فنانس ڈیپارٹمینٹ پی سی سول سیکرٹریٹ لاہور دوبارہ ڈیزائن کردہ پوسٹ کے 05 نوٹیفیکشن نکال چکا تھا۔ جنکی تفصیل درج ذیل ہے ۔

اب کورٹ کے حکم نظرثانی پرفنانس ڈیپارٹمینٹ پی سی سول سیکرٹریٹ لاہور نے 2009 کے نوٹیفیکشن کی بجائے مذکورہ ٹیبل کے سریل نمبر۔02 کے نوٹیفیکشن اکاؤنٹس سے متعلق پوسٹ کو دوبارہ ڈیزائن کے مطابق ہمیں اپگریڈ/دوبارہ عہدہ اکاونٹس کلرک سکیل نمبر-08سے جونیئر اکاوٹنٹ سکیل نمبر۔11 کے آرڈر مورخہ۔2019/09/18 کردیئے۔جبکہ اس وقت بھی ہماری سروس 24سال اور 05ماہ 20دن تھی۔ جناب والا توجو طلب بات ہے کہ کورٹ نظرثانی 2009 کے نوٹیفیکشن کاحکم صادر کرتی ہے اور فنانس لاہور 2018/12/14 کے نوٹیفیکشن پراۤرڈر کرکے کورٹ آف کنڈکٹ کیا ہے۔نہ صرف ہمیں بلکہ کورٹ کو بھی گمراہ کیا ہے کیونکہ لاہور ہائی کورٹ لاہور کے مورخہ۔2021/09/21 کے فیصلے نے فنانس کاکچاچٹھا کھول کر رکھ دیا۔
