Clarification of Protection of Pay from Higher to Lower Pay Scales and Time Scale

Government of Sindh, Finance Department issued a Notification on 05-12-2022 in connection with the Clarification of Protection of Pay from Higher to Lower Pay Scales and Time Scales. The main points of the Notification are as under:

Protection of Pay from Higher to Lower Pay Scales

  • The Employees will get basic pay protection from a higher pay scale to a lower pay scale if the employee got LIEN in the previous post and other conditions
  • The basic pay of the employee of a lower pay scale will also be protected on promotion if he draws salary in a higher pay scale due to time scale.
  • The employee however will get other allowances like House Rent Allowance, Conveyance Allowance, Medical Allowance, etc as per the promotion pay scale.
  • The employees of the province of Sindh only will get the benefit of this Notification

Clarification of Notification

               In supersession of this department’s letter No. FD(SR-III03-629/2020, dated 24th November 2020, and in light of the opinion of Advocate General, Sindh received through the Regulation wing, Services general administration & Coordination Department vide U.O. Nos. SOR-III(SGA&CD)9-25/2019, dated 9th August 2021, and SOR-III(SGA&CD(5-13/2022 dated 7th November 2022, regarding the interpretation of Rule-41  & 42 of Sindh Civil Services Rules, manual volume-1, it is clarified that the basic pay of the incumbent will be protected from higher to lower grade subject to the condition that his/her lien is kept in the previous service and subject to the other provisions as specified vide this department’s circular No. FD(SR-I)1(30)/83, dated 3rd June, 2016.

                It is further clarified that the Basic pay of the incumbent of lower grade and drawing salary on higher grade on the basis of this scale will be protected upon his/her promotion. However, other allowances such as house rent allowance, conveyance allowance, etc., shall be admissible as per the scale of post-on promotion.
