Clarification Pension Related Matters MTI of KPK
The following clarification is issued for the settlement of pension cases/issues of the employees working in Medical Teaching Institutions in Khyber Pakhtunkhwa:-
CLARIFICATION ON PENSION-RELATED MATTERS OF MEDICAL TEACHING INSTITUTIONS OF KHYBER PAKHTUNKHWA
This clarification is issued for pension-related matters of Medical Teaching Institutions (MTIs) employees under existing relevant laws. For different types of MTI employees, the Finance Department is providing the following guiding principles for all pension-related matters:
Guiding Principals
- All administrative and teaching staff recruited by the Management Council in the prescribed manner under the repealed Khyber Pakhtunkhwa Medical and Health Institution and Regulation of Health Care Services Ordinance, 2002 in light of section 16(2) of the MTI Act 2015: These employees were treated as civil servants at the time of promulgation of MTI Act 2015. Since the promulgation of the MTI Act 2015, these are now treated as Institutional employees. The provincial Government will provide pensionary benefits to these employees as mentioned above for the entire period of service i.e. civil service before the commencement of the MTI Act 2015 and the institutional employment period after the commencement of the MTI Act 2015, according to provincial Government pension rules through the office of Accountant General of Khyber Pakhtunkhwa
- Civil servants who opted for MTI services in light of section 16(3) of the MTI Act: For these civil servants the Provincial Government will provide pensionary benefits for the period during which they served as civil servants according to provincial Government pension rules through the office of Accountant General of Khyber Pakhtunkhwa. For the period after the promulgation of the MTI Act 2015, when these no longer remained as civil servants, the MTI shall deposit pension contribution on their behalf as per their rules and regulations.
- Civil servants who are on deputation to the MTIs in light of section 16 (3A) of the MTI Act 2015: The provincial Government will provide pensionary benefits to such employees for the entire period of service spent as a civil servant on deputation in the respective MTI, according to provincial Government pension rules through the office of Accountant General of Khyber Pakhtunkhwa.
- d. Employees who have been hired by the MTI after the promulgation of the MTI Act 2015: The pension of these employees shall be the responsibility of respective MTIs.
Verification of service and pay of MTI employees
Verification of service and pay of MTI employees for the period spent as civil servants and as institutional employees as referred to at point 1(a), shall be done by a Committee constituted in the Health Department with the representation of the Accountant General office. The Committee shall dispose of each individual case within 14 days of receipt of the case. The respective MTI shall send cases of these employees.
Adoption of a Specific Grading System
In case an MTI decides to adopt a specific grading system, then the Finance Department, Khyber Pakhtunkhwa in consultation with the respective MTI shall finalize the equivalence of the MTI grading system with corresponding BPS for civil servants on deputation and institutional employees. Concerned MTI shall pay the pension differential, potentially arising out of remuneration differences between the MTI-specific grading system and the corresponding BPS system, to the institutional employees being affected as referred to at point no 1(a).
