Petition against the Amendments in Leave Rule 1981 (Leave Encashment)

There are the latest updates on leave encashment in Punjab as a Petition against the Amendments in Leave Rule 1981 has been launched and a hearing held too. Mohammad Hanif son of Imam Ali residence of Hakim Gali near Masjid Khan Bahadur Wali post office District Sheikhu Pura registers petition under article 199 of the constitution of the Islamic Republic of Pakistan 1973.  He made this petition against the Province of Punjab through the Chief Secretary of Punjab, The Finance Secretary province of Punjab, and the Additional Finance Secretary province of Punjab.

 

Details of the Petition against the Amendments in Leave Rule 1981 (Leave Encashment)

 

The petitioner was an employee of the Municipal Committee Sharqpur Sharif district Sheikhu Pura. He was serving as the octree clerk Municipal Committee district Sheikhu Pura. The employee was serving the department his services in the best way. He retired from the service-wide order number MC-SQP 23/53 dated on 15th February 2023. The chief officer Municipal Committee Sharqpur Sharif district Sheikhu Pura issues his order letter of retirement. The petitioner receives the orders with the benefits of pension as admissible under the rules. He was also elected as vice president during his service in the municipal committee of Sharqpur Sharif district Sheikhu Pura. A copy of the retirement letter is also attached to their petition application.

 

Illegal And Un-Lawful Amendments Leave Encashment

 

Respondent No.3 The Secretary of Finance issues notification number F.DSR.II-97 2019 dated 1st June 2023. He issues notification on the orders of the Governor of Punjab. As governor of Punjab makes amendments to the revised leaves rule 1981.  There is the introduction of illegal and unlawful amendments regarding payment of LPR on the basis of basic pay scales are totally changed.

Interim Government cannot Make Amendments In Leave Rule 1981

 

The petitioner challenges the amendments made through the notification dated 1st June 2023 in Revised Leave Rules 1981. According to the challenge the interim government has no mandate and rights to carry out such amendments.

 

Notice to The Respondents

 

According to Judicial Department Notice to the respondents for 18/9/2023 is also issued to the learned Advocate General Punjab.  The issuance of the letter is in terms of order XXVII-A of the Code of Civil Procedure 1908.

Notice for the above date in the meanwhile the effect of such amendments shall be subject to the final outcome of the present petition.

 

 CM No.02/2023

 

Subject to all just and legal expectations dispensation sought for is allowed CM stands disposed of.
