Subject: IMPLEMENTATION OF SUPREME COURT ORDER IN CIVIL PETITION NO. 3390 OF 2021
I am directed to refer to the Supreme Court of Pakistan’s Judgment dated 18.10.2024 in Civil Petition No. 3390 of 2021 (copy enclosed) and Khyber Pakhtunkhwa Civil Servants (Appointment, Promotion, and Transfer) Rules, 1989 and to state that the August Supreme Court of Pakistan in its judgment has held that the appointment of a widow/widower, wife/husband, or child of a civil servant in different grades on a contract or regular basis, without advertisement, competition, and merit, is violative of Articles 3, 4, 5(2), 18, 25(1), and 27 of the Constitution of the Islamic Republic of Pakistan.
- In light of the above, the Supreme Court has directed all Federal and Provincial authorities to withdraw all policies, acts, and procedures that allow appointments without open advertisement, competition, and merit to the widow/widower, wife/husband, or child of civil servants in different grades, and/or in cases where the servant became permanently disabled/invalidated/incapacitated or died during service.
- In light of the above order, all future appointments to the Khyber Pakhtunkhwa Government must be made in strict compliance with the Supreme Court order, ensuring merit and transparency.
- It is clarified that the above order does not affect the policies, rules, or compensation packages of the Federal and Provincial Governments for the benefit of the legal heirs of martyred personnel of law enforcement agencies and civil forces who die due to terrorist activities.
